“Account” means the registered customer account created on the Website for placing orders and accessing related services.

“Business Day” means any day other than a Sunday or public holiday on which banks are generally open for business in India.

“Customer / User / You / Your” means any individual who accesses, browses, registers on, or purchases products through the Website.

“Order” means a request submitted by a Customer through the Website to purchase one or more Products.

“Product” means any apparel, garment, accessory, or other merchandise offered for sale on the Website.

“Website” means the official website of the Company, namely www.trishnae.com.

“Trishnaé / We / Us / Our” means Trishnaé Apparel Private Limited, the owner and operator of the Website.

“Policies” means the Shipping & Delivery Policy, Exchange Policy, Cancellation & Refund Policy, Privacy Policy and any other policy published on the Website, as amended from time to time.

“Applicable Law” means all applicable laws, rules, regulations, notifications, judicial decisions and governmental directions in force.

2.1 You must be at least 18 years old or the age of legal majority in your country of residence if that age is higher, to place an order on www.trishnae.com.

2.2 If you are under 18 years old, you may use the website or place an order only under the supervision and consent of a parent or legal guardian.

2.3 Trishnaé does not currently offer guest checkout. Customers are required to create or use an account to place orders, manage purchases, request cancellations, or request exchanges.

2.4 You agree to provide accurate, complete, and updated information when creating an account, placing an order, requesting an exchange, requesting cancellation, or contacting customer support.

2.5 You are responsible for maintaining the confidentiality of your account login details and for all activity carried out through your account.

2.7 By using this website, you agree that you will not:

a. Use the website for unlawful, fraudulent, abusive, or harmful purposes;

b. Provide false, misleading, incomplete, or inaccurate information;

c. Attempt unauthorised access to our website, systems, accounts, data, or payment processes;

d. Interfere with the security, functionality, or operation of the website;

e. Copy, scrape, extract, or misuse website content, images, product information, customer data, or brand assets;

f. Use the website to make false claims, abusive complaints, or fraudulent requests; or

g. Misuse our policies, offers, promotional codes, exchange process, cancellation process, or customer support channels.

h. Use bots, scrapers, automated scripts, or similar means to place orders, monitor stock or pricing, or otherwise interact with the website.

2.8 Trishnaé reserves the right to refuse service, restrict account access, cancel orders, reject requests, or take appropriate action where we have reasonable grounds to suspect misuse, fraud, unauthorised activity, abusive conduct, or violation of these Terms.

3.1 Trishnaé collects and processes personal information necessary to operate the website, create customer accounts, process orders, arrange shipping, manage cancellations and exchanges, provide customer support, process payments, prevent fraud, improve services, and communicate with customers.

3.2 Personal information may include details such as your name, email address, phone number, billing address, shipping address, order details, account details, communication history, and information submitted through forms, reviews, exchange requests, or customer support.

3.3 Payment details such as full card numbers, CVV, and card expiry details are not stored by Trishnaé. Payments are processed through secure third-party payment gateways and payment service providers.

3.4 Your personal information is handled in accordance with our separate Privacy Policy, that can be further accessed on our website.

3.5 By using our website, creating an account, placing an order, or communicating with us, you agree that your information will be collected and processed in accordance with our Privacy Policy and applicable law.

3.6 Marketing communication, where applicable, will be sent only in accordance with applicable consent requirements and customer preferences.

3.7. Where applicable, your personal data is processed in accordance with the Digital Personal Data Protection Act, 2023. For customers located in other jurisdictions with their own data protection laws, Trishnaé takes reasonable steps to process personal data consistently with the applicable local data protection requirements to the extent they apply to us.

4.1 Trishnaé makes reasonable efforts to display product details accurately, including product descriptions, fabric information, pricing, sizing, height options, care details, availability, and product images.

4.2 Minor variations in colour, texture, weave, print placement, embroidery, finish, or appearance may occur due to fabric nature, hand processes, lighting, photography, editing, screen settings, or device display differences.

4.3 Such minor variations will not be treated as product defects.

4.4 Customers are requested to review product descriptions, size guides, height options, fit notes, garment measurements, care instructions, and product images carefully before placing an order.

4.5 Product availability is subject to stock at the time of order processing.

4.6 Trishnaé reserves the right to update, correct, modify, or remove product information, pricing, images, descriptions, offers, or availability without prior notice.

4.7 We do not guarantee that every product shown on the website will be available at all times.

4.8. Products are offered in sizes S, M, L, and XL, each available in Petite, Regular, and Tall height options, based on Indian standard sizing conventions. As sizing conventions vary between countries, international customers are strongly encouraged to rely on the garment measurements (dimensions) provided in the product description, rather than the size label alone, before placing an order.

5.1 Product prices on www.trishnae.com may be displayed in Indian Rupees (INR) or in your destination country currency, depending on the customer’s IP location and selected currency preference.

5.2 Prices displayed on the website are inclusive of applicable taxes, unless otherwise mentioned.

5.3 Shipping charges, international shipping charges, customs duties, import taxes, clearance fees, bank charges, currency conversion charges, or payment provider charges may be additional and will be handled in accordance with our Shipping & Delivery Policy.

5.4 International customers may be charged additional customs duties, import taxes, clearance fees, or local charges by the destination country. These charges are the customer’s responsibility unless expressly stated otherwise.

5.5 Prices, offers, discounts, promotional codes, launch offers, and campaigns may be changed, withdrawn, or discontinued by Trishnaé at any time.

5.6 Promotional codes may be subject to specific terms, including validity period, product exclusions, minimum order value, non-cancellability, non-exchangeability, or other conditions clearly communicated at the time of use.

5.7 Trishnaé reserves the right to reject, cancel, or reverse the use of a promotional code if it is expired, technically incorrect, misused, used against the terms of the offer, shared without authorisation, or applied due to a technical error.

5.8 If a pricing error, product information error, discount error, or technical error occurs, Trishnaé reserves the right to cancel the affected order and process a refund to the original payment method where payment has already been received.

5.9. Where your card or payment account is denominated in a currency other than the currency in which you pay at checkout, your card issuer, bank, or payment provider may apply its own currency conversion rate and may levy additional currency conversion, cross-border transaction, or foreign exchange charges. Trishnaé does not control and is not responsible for these charges.

5.10. Trishnaé arranges export of the goods from India, but the customer is the importer of the goods into the destination country. Customs duties, import taxes, VAT/GST, and clearance fees (if applicable) are determined by the destination country's authorities, are not included in the product price or shipping charges paid at checkout, and are collected from customer directly by the courier partner or the local customs office at the time of delivery, in accordance with our Shipping & Delivery Policy.

5.11. Customers are responsible for making themselves aware of the customs duty, tax, and de minimis thresholds applicable in their destination country before placing an order, as these are set by the destination country and may change without notice to Trishnaé.

6.1 Placing an order on www.trishnae.com does not automatically guarantee acceptance of the order.

6.2 Orders are confirmed only after successful payment and order acceptance by Trishnaé.

6.3 Trishnaé does not offer Cash on Delivery. All orders must be prepaid through the payment methods available at checkout.

6.4 Trishnaé reserves the right to accept, reject, cancel, or refuse any order before dispatch for valid reasons, including but not limited to:

a. Product unavailability;

b. Pricing or product information error;

c. Payment failure or payment verification issue;

d. Incorrect, incomplete, or suspicious customer details;

e. Suspected fraudulent activity;

f. Misuse of promotional codes or offers;

g. Bulk purchasing or suspected unauthorised resale;

h. Serviceability issues with the delivery address;

i. Abusive or inappropriate customer conduct; or

j. Any operational reason that prevents us from fulfilling the order; or

k. Legal, regulatory, sanctions, or customs restrictions applicable to the destination country or the customer.

6.5 If Trishnaé cancels an order after payment has been successfully received, a refund will be processed to the original payment method in pursuance of the cancellation and refund policy, unless the cancellation is connected to suspected fraud, payment dispute, chargeback misuse, or an issue requiring investigation by the payment provider or relevant authority.

6.6 Customers are responsible for ensuring that order details, delivery address, contact number, email address, size, height option, product selection, and payment details are accurate before completing the purchase.

6.7. For international orders, the customer is responsible for providing a delivery address, contact number (with country code), and any tax or import registration identifier required by the destination country's customs authority for clearance. Delays, additional charges, or failed delivery arising from incomplete or inaccurate information provided by the customer are the customer's responsibility.

7.1 Shipping and delivery are governed by our Shipping & Delivery Policy.

7.2 Delivery timelines provided on the website or in order communication are estimates only and are not guaranteed.

7.3 Trishnaé is not responsible for delays caused by courier partners, customs authorities, incorrect customer details, customer unavailability, failed delivery attempts, public holidays, weather conditions, force majeure events, or other circumstances outside our reasonable control.

7.4 Once the courier partner confirms delivery to the address provided at checkout, the order will be treated as delivered.

7.5 If an order is marked delivered but has not been received, the customer must contact Trishnaé within 24 hours of the delivery update so that a courier investigation can be requested.

7.6 Trishnaé will make reasonable efforts to assist with courier-related concerns, but courier investigation outcomes are subject to the courier partner’s records, proof of delivery, and delivery process.

7.7. Risk of loss or damage to the products passes to the customer once the order is marked as delivered by the courier partner, whether the order is shipped within India or internationally, consistent with our Shipping & Delivery Policy.

7.8. If a shipment is delayed, held, or returned by customs authorities due to non-payment of duties, incomplete documentation, or destination-country restrictions, Trishnaé will make reasonable efforts to notify the customer, but is not liable for the delay, seizure, confiscation, or destruction of goods by any customs or governmental authority.

7.9. Trishnaé may restrict or decline to ship certain products, or ship to certain countries or regions, where required by law, regulation, sanctions, customs restrictions, or logistical constraints.

8.1 Exchanges, cancellations, refunds, refused delivery, failed delivery, damaged products, incorrect products, and defective products are governed by our Exchange Policy, Cancellations & Refund Policy, and Shipping & Delivery Policy.

8.2 Trishnaé offers eligible customers a one-time exchange only, subject to the conditions stated in the Exchange Policy.

8.3 Returns and refunds are not offered for change of mind, fit preference, colour preference, style preference, customer-selected size issues, or customer-led cancellation requests made after the order has entered the shipping stage.

8.4 Orders may be cancelled only in accordance with our Cancellations & Refund Policy.

8.5 Refunds, where approved, will be processed only to the original payment method used at the time of purchase.

8.6 This clause does not limit or exclude any remedies available to customers under applicable law for products received in a damaged, defective, incorrect, or misdescribed condition.

8.7. The one-time exchange facility referred to in Clause 8.2 is available only for orders shipped within India. Exchanges are currently not available for international orders, due to customs, duties and cross-border logistics limitations, as set out in the Exchange Policy. If an international order is received in a damaged, defective, incorrect, or misdescribed condition, please contact us at hello@trishnae.com within 24 hours of delivery with your order number, clear photographs, and a description of the issue, subject to the Exchange Policy.

8.8. Non-refundable shipping charges already incurred at the time of shipment will not be refunded on a cancellation, return, or exchange, except where the return arises from a defective, damaged, incorrect, or misdescribed product, or where required by applicable law.

8.9. Orders for delivery outside India cannot be cancelled once confirmed, due to customs, duties and cross-border logistics limitations, as set out in the Cancellations & Refund Policy.

9.1 Customers may be allowed to submit reviews, ratings, feedback, testimonials, or other comments through the website, email, social media, or other communication channels.

9.2 Reviews submitted on the website may be moderated before publication.

9.3 Trishnaé reserves the right not to publish or to remove reviews or comments that are abusive, offensive, misleading, false, defamatory, discriminatory, irrelevant, promotional, spam, unlawful, or unrelated to the product or customer experience.

9.4 By submitting a review or testimonial directly to Trishnaé for publication, you confirm that the content is based on your genuine experience and that you have the right to share it.

9.5 By submitting a review or testimonial through our website, you grant Trishnaé permission to display, reproduce, edit for clarity or length, and use the submitted text for website, marketing, or customer experience purposes, without changing the meaning of your review.

9.6 Trishnaé will not use customer photographs, videos, social media posts, or tagged content for marketing or reposting without written consent from the customer.

9.7 Written consent may be obtained by email, direct message, or another written communication channel.

9.8 Trishnaé may retain written consent records for internal compliance and brand protection purposes.

10.1 All content on www.trishnae.com, including but not limited to images, product photographs, garment designs, artwork, prints, graphics, logos, brand name, website layout, text, copy, styling, icons, videos, lookbooks, design elements, and other materials, belongs to Trishnaé or is used by Trishnaé with permission.

10.2 No content from the website may be copied, reproduced, downloaded, modified, published, sold, commercially used, distributed, imitated, scraped, or used without prior written permission from Trishnaé.

10.3 Unauthorised use of Trishnaé’s brand name, product images, garment designs, artwork, prints, website content, or intellectual property may result in legal action.

10.4 Nothing on this website grants any licence or right to use Trishnaé’s intellectual property without written permission.

10.5 This website may contain links to third-party websites, payment gateways, courier tracking pages, social media platforms, or other external services.

10.6 Trishnaé is not responsible for the content, accuracy, security, availability, privacy practices, policies, or actions of third-party websites or services.

10.7 Accessing third-party links is at the customer’s own discretion and risk.

10.8. "Trishnaé" and associated logos, marks, and brand names are trademarks of Trishnae Apparel Private Limited, whether or not registered. Nothing in these Terms grants any right to use them without prior written permission.

11.1 Products sold on www.trishnae.com are intended for personal use only.

11.2 Customers may not purchase products for unauthorised resale, commercial resale, marketplace listing, rental, imitation, copying, design reproduction, or any commercial activity without prior written permission from Trishnaé.

11.3 Trishnaé reserves the right to cancel or refuse orders that appear to be bulk purchases, suspicious purchases, unauthorised resale activity, or purchases made for commercial misuse.

12.1 Trishnaé reserves the right to refuse service, cancel orders, restrict account access, reject exchange/cancellation/refund requests, or take appropriate action where we have reasonable grounds to suspect fraud, abuse, or misuse.

12.2 Misuse may include, but is not limited to:

a. False claims of damage, defect, incorrect delivery, non-delivery, or missing items;

b. Repeated cancellations, refused deliveries, or failed delivery patterns;

c. Chargeback misuse or payment disputes made in bad faith;

d. Abuse of promotional codes, discounts, offers, or website errors;

e. Returning worn, altered, washed, used, damaged, or tampered products as unused;

f. Tampering with tags, labels, security tags, packaging, or product condition;

g. Creating multiple accounts to misuse offers or avoid restrictions;

h. Unauthorised resale or commercial misuse;

i. Providing false, incomplete, or misleading information; or

j. Abusive, threatening, discriminatory, or inappropriate communication with Trishnaé’s team.

12.3 Any decision to restrict or reject a request will be made after reasonable review of order history, communication, courier records, payment records, product condition, account activity, and available evidence.

13.1 To the maximum extent permitted by applicable law, Trishnaé will not be liable for any indirect, incidental, special, consequential, punitive, or economic loss arising from use of the website, delay in delivery, inability to use the website, product unavailability, third-party service failure, or use of products purchased from the website.

13.2 Trishnaé does not guarantee that the website will always operate without interruption, error, delay, virus, technical issue, or security risk.

13.3 We may temporarily suspend or restrict website access for maintenance, updates, technical issues, security reasons, or operational requirements.

13.4 In no event shall Trishnaé, or its respective officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, suppliers, attorneys or agents, be liable to you for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantage). Trishnaé’s total liability for any order-related claim shall not exceed the amount paid by the customer to Trishnaé for the specific product or order giving rise to the claim, except where a different remedy is required under applicable law.

13.5 Nothing in these Terms limits or excludes any rights or remedies available to customers under applicable law.

13.6. Without limiting Clause 13.1, Trishnaé is not liable for any customs delay, denial of entry, seizure, confiscation, or destruction of goods by any customs or governmental authority, or for any duty, tax, tariff, or penalty levied by a destination country, whether or not disclosed at the time of order.

13.7. You agree to defend, indemnify and hold harmless Trishnaé, its digital platform, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon a breach of any warranty, representation or undertaking in this Service Level Agreement, or arising out of a violation of any applicable law (including but not limited in relation to intellectual property rights, payment of statutory dues and taxes, claims of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights). This clause shall survive the expiry or termination of this Service Level Agreement.

14.1 Trishnaé will not be responsible for failure or delay in performing any obligation where such failure or delay is caused by events outside our reasonable control.

14.2. Such events may include, but are not limited to, natural disasters, extreme weather, floods, fires, epidemics, pandemics, government restrictions, lockdowns, strikes, transport disruptions, customs delays, courier disruptions, changes in trade policy, tariffs, export or import restrictions or bans, sanctions, technical failures, internet failures, cyber incidents, payment gateway issues, war, civil unrest, or any other event beyond our reasonable control.

14.3 In such cases, Trishnaé will make reasonable efforts to resume normal operations as soon as possible.

15.2 Please include your order number in all order-related communication so we can assist you more efficiently.

15.3 We aim to respond to customer support queries within 2 business days, excluding Sundays and public holidays.

15.5 Grievances will be acknowledged within 48 hours of receipt.

15.6 Trishnaé will aim to resolve grievances within one month from the date of receipt, subject to the nature of the complaint, availability of information, courier investigation timelines, payment provider timelines, or any other external dependency.

15.7 Customers may be provided with a complaint reference or ticket number for tracking where applicable.

16.1 These Terms & Conditions are governed by and interpreted in accordance with the laws of India.

16.2. If a dispute arises between you and Trishnaé, in such case, you and Trishnaé hereby agree to resolve any claim or controversy that arises out of these Terms and Conditions through mutual discussions for at least thirty (30) days before initiating arbitration.

16.3. In case of non-resolution through mutual discussions, the dispute shall be referred to Arbitrator appointed under the Arbitration Act referred herein finally resolved through Arbitration following the procedure mentioned in the Arbitration and Conciliation Act, 1996 and applicable rules.

16.4. Subject to applicable consumer protection laws and any mandatory legal rights available to customers, the courts at Bengaluru, Karnataka, India shall have exclusive jurisdiction over disputes arising from or relating to these Terms, use of the website, or purchases made through www.trishnae.com.

16.5. Nothing in this clause limits any rights available to customers under applicable consumer protection laws.

17.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or competent authority, the remaining provisions will continue to remain valid and enforceable.

17.2 The invalid or unenforceable provision will be replaced or interpreted in a manner that most closely reflects the original intention, to the extent permitted by law.

18.1 If Trishnaé does not enforce any right or provision under these Terms at any time, this does not mean that Trishnaé has waived that right or provision.

18.2 Trishnaé may enforce its rights under these Terms at any later time where permitted by law.

19.1 Trishnaé reserves the right to update, modify, or replace these Terms from time to time.

19.2 The updated version will be published on this page with the latest effective date, where applicable.

19.3 Continued use of the website after changes are published will be treated as acceptance of the updated Terms.

19.4 Customers are encouraged to review these Terms periodically before placing an order.

20.1. These Terms, together with the Shipping & Delivery Policy, Exchange Policy, Cancellations & Refund Policy, and Privacy Policy, constitute the entire agreement between you and Trishnaé regarding your use of the website and purchases made through it, and supersede all prior discussions, communications, or agreements on the subject.

21.1. You consent to receive all communications from Trishnaé - including order confirmations, policy updates, notices, and other disclosures - electronically, whether by email, SMS, WhatsApp, or by posting on the website, and agree that such electronic communications satisfy any legal requirement that such communications be in writing.

22.1. These Terms are drafted in English. Any translation made available for convenience shall not override the English version, which shall prevail in the event of any conflict or discrepancy.

23.1. These Terms take effect from the date you first access the website, create an account, or place an order (whichever is earliest), and continue to apply for as long as you have an account with, or otherwise use, www.trishnae.com.

23.2. You may stop using the website, or request closure of your account, at any time by writing to us at hello@trishnae.com. Account closure does not cancel or affect any order already placed and confirmed, which will continue to be governed by these Terms until fulfilled, returned, exchanged, or refunded in accordance with the applicable policy.

23.3. Trishnaé may suspend or terminate your account or access to the website, without prior notice, where you breach these Terms, engage in fraud, abuse, or misuse as described in Clause 12, or where required by law or regulation. Where reasonably practicable, Trishnaé will inform you of the reason for suspension or termination.

23.4. Trishnaé may also discontinue the website or any part of it, with reasonable notice where practicable, without liability to you, save for fulfilling orders already confirmed and paid for at the time of discontinuation (or refunding them where they cannot be fulfilled).

23.5. Termination of your account or these Terms, for any reason, does not affect any rights, obligations, or liabilities that have already accrued as of the date of termination, including payment obligations, and does not affect the continued application of these Terms each of which survives termination.

23.6. Your personal data will continue to be held and processed after account closure only as described in, and for the retention periods set out in, our Privacy Policy.

24.1. Any notices or other communications required or permitted in terms of these presents shall be deemed to have been duly served if, (a) delivered in person; or (b) sent by registered or certified mail, return receipt requested, or (c) email; and addressed referred below.
